Terms and Conditions for Session Bookings
Website: anukushwaha.com
Effective date: 01 August 2026
Last updated: 04 August 2026
These Terms and Conditions govern your access to anukushwaha.com and your booking or participation in one-to-one consultations, wellbeing sessions, coaching conversations, workshops, programmes and related services offered by Anu Kushwaha.
By using this website, submitting a booking, making a payment, selecting an acceptance checkbox or participating in a session, you confirm that you have read, understood and agreed to these Terms and Conditions.
1. Service provider
The services are provided by:
Name: Anu Kushwaha
Business or brand name: Back To Wellbeing
Business address: Kalp City, Bijnor road, Lucknow, Uttar Pradesh, India
Email: hello@anukushwaha.com
Telephone: +91 9959866113
Website: anukushwaha.com
In these Terms, “I”, “me”, “my” and “Provider” refer to Anu Kushwaha. “You”, “your” and “Client” refer to the person booking or receiving the services.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a contract to book a session independently.
Services for anyone below 18 years of age will be provided only where appropriate and after obtaining prior written consent from a parent or lawful guardian. I may also require the parent or guardian to sign a separate consent agreement.
You confirm that the information you provide while booking is accurate, complete and your own.
3. Nature and scope of the services
The sessions support areas such as:
- Personal development
- Stress management
- Emotional wellbeing
- Mental clarity
- Behavioural change
- Personal and professional performance
- Work-related overwhelm or anxiety
- Burnout prevention and wellbeing
- Development of supportive habits and mind-body awareness
Depending on your individual needs, comfort and goals, a session may include coaching conversations, cognitive hypnosis, NLP-based techniques, reflective exercises, behavioural tasks and mind-body practices informed by psychology and Classical Yoga.
I do not use every method with every Client. I select suitable approaches after considering your concerns, preferences, comfort, responses and desired outcomes. You may ask questions, decline a proposed exercise or withdraw your participation in a particular technique at any time.
4. Non-clinical nature of services
Unless expressly stated otherwise in writing, these services are intended for personal development, stress management, emotional wellbeing and performance-related concerns.
They do not constitute or replace:
- Medical advice, diagnosis or treatment
- Psychiatric assessment or treatment
- Clinical psychology services
- Psychotherapy
- Prescription medication
- Emergency mental-health intervention
- Treatment for a diagnosed physical or mental-health condition
No doctor-patient, psychiatrist-patient or clinical healthcare-provider relationship is created through your use of this website or participation in a session.
You should continue any treatment prescribed by a qualified healthcare professional and should not stop or change medication or treatment based on a session without consulting the relevant healthcare professional.
5. Emergencies and urgent mental-health concerns
This website and its services do not provide crisis intervention or emergency support.
Do not book a regular consultation as a substitute for emergency assistance. If you believe that you or another person may be at immediate risk of suicide, self-harm, violence, abuse, medical emergency or serious psychiatric crisis, contact the appropriate emergency service, hospital, licensed mental-health professional or local crisis-support service immediately.
Messages, emails and booking forms may not be reviewed instantly and must not be used for emergency communication.
6. Suitability, referral and professional support
You are responsible for disclosing information that may materially affect the safety or suitability of the session, including relevant medical conditions, mental-health diagnoses, current treatment, medication, pregnancy, recent surgery, physical limitations or a history of severe psychological distress.
I may recommend that you obtain medical clearance or consult a psychiatrist, clinical psychologist, physician or another appropriately licensed healthcare professional before beginning or continuing the sessions.
I may decline, pause or discontinue services when:
- Your concerns fall outside the scope of my services;
- Specialised clinical or medical support appears more appropriate;
- Continuing may create a safety or ethical concern;
- Necessary information has not been disclosed;
- Your behaviour is threatening, abusive, discriminatory or inappropriate; or
- A conflict of interest or professional-boundary concern arises.
A referral recommendation does not represent a diagnosis.
7. Informed consent and Client Agreement
First-time Clients may be required to review and sign a separate Client Agreement and Informed Consent Form before the first session.
The separate agreement may explain the proposed methods, confidentiality, boundaries, possible benefits and limitations, emergency procedures, responsibilities and data practices in greater detail.
Your appointment may remain pending until I receive the completed agreement. If you do not complete it within the stated time, I may release the reserved appointment slot.
Where a separate signed agreement conflicts with these Terms, the signed agreement will apply to the session-specific matter, subject to applicable law and your statutory consumer rights.
8. Booking process
A booking is complete only after:
- You submit the required booking information;
- You accept the applicable Terms and policies;
- The required payment is successfully processed;
- You complete any required Client Agreement or consent form; and
- You receive confirmation that the appointment is approved.
A payment receipt alone does not necessarily mean that an appointment has received final approval.
You must check the name, email address, telephone number, selected service, date, time and time zone before submitting your booking.
9. Fees and payments
The applicable session fee will appear on the booking page before payment.
Payments may be processed through third-party payment gateways such as Razorpay, WooCommerce or another authorised provider. Their own terms, privacy practices, transaction limits and security procedures may also apply.
You are responsible for:
- Providing valid payment information;
- Paying the displayed fee and applicable taxes;
- Any bank, card, foreign-exchange or international transaction charges; and
- Confirming that your payment was successfully completed.
I do not normally receive or store your complete debit-card or credit-card details.
Prices may change for future bookings. A price change will not ordinarily affect an appointment already confirmed and paid for, unless an obvious technical or pricing error occurred.
10. Refund and rescheduling policy
All payments are generally non-refundable once a booking has been confirmed.
However, you may request to reschedule your appointment once to a future available date by giving at least 24 hours’ notice before the scheduled start time.
The rescheduled session must normally take place within 90 days of the original appointment date, unless otherwise agreed in writing.
Rescheduling remains subject to:
- Appointment availability;
- Receipt of the request within the notice period;
- Completion of any pending forms or agreements; and
- Compliance with these Terms.
Requests made less than 24 hours before the session, missed appointments and no-shows may be treated as completed sessions and may not qualify for rescheduling.
I may consider genuine emergencies or exceptional circumstances at my reasonable discretion.
Nothing in this clause limits any refund, remedy or consumer right that cannot lawfully be excluded. A refund or suitable alternative will be offered where:
- I cancel the session and cannot provide a reasonable alternative;
- The service cannot be delivered due to circumstances within my control;
- A duplicate or clearly incorrect payment was collected; or
- Applicable law requires a refund.
Approved refunds will be returned through the original payment method where reasonably possible. Taxes, bank or payment-gateway processing fees may apply and is not refundable.
11. Provider cancellation or rescheduling
I may reschedule a session because of illness, emergency, technical failure, travel disruption, safety concerns or another unavoidable circumstance.
Where this happens, you may choose an available replacement appointment. If I cannot provide a reasonable replacement, you may request a refund of the affected session fee.
I will not be responsible for incidental expenses such as travel, accommodation, loss of earnings or other indirect costs arising from a rescheduled appointment, except where liability cannot legally be excluded.
12. Late arrival and session duration
A typical session lasts approximately 60 minutes. However, some sessions may take longer depending on the methods used and the time needed for reflection and response.
If you arrive late, the session may still end at the originally scheduled time to avoid affecting another Client’s appointment. The full fee will ordinarily remain payable.
If I start the session late, I will make reasonable efforts to provide the agreed session duration or arrange an appropriate alternative.
13. Online sessions
Online sessions require:
- A reliable internet connection;
- A suitable device with working audio and video, where required;
- A quiet and private environment;
- Updated software; and
- Reasonable steps to protect your login details and meeting link.
Although reasonable care will be taken, online communication cannot be guaranteed to remain uninterrupted or completely secure.
If a technical problem materially disrupts the session, we may reconnect, continue by another agreed method or reschedule the remaining time. Repeated technical problems caused by your equipment, connection or environment may not qualify for a refund.
You must not share your private meeting link with another person.
14. Your responsibilities
You agree to:
- Participate voluntarily and honestly;
- Provide relevant and accurate information;
- Ask for clarification when you do not understand something;
- Inform me if you experience discomfort or distress;
- Obtain medical advice when appropriate;
- Avoid attending while impaired by alcohol, recreational drugs or non-prescribed substances;
- Complete agreed exercises only within your physical and emotional comfort;
- Respect appointment times and professional boundaries; and
- Take responsibility for your personal decisions and actions between sessions.
You remain responsible for deciding whether and how to apply any discussion, reflection or exercise.
15. Mind-body and Yoga-based practices
Any breathing, movement, relaxation, meditation or other mind-body practice must be performed within your individual capacity.
Stop immediately and seek appropriate assistance if you experience pain, dizziness, breathing difficulty, severe distress or another concerning symptom.
You should consult an appropriate healthcare professional before participating where you have a medical condition, injury, pregnancy, recent surgery or another relevant health concern.
These practices do not replace medical evaluation, rehabilitation or treatment.
16. Confidentiality and its limits
I will treat the personal information you share during sessions as confidential and will use reasonable measures to protect it.
However, confidentiality is not absolute. Information may be disclosed where reasonably necessary:
- With your consent;
- To provide or administer the booked service;
- To payment, technology, document-signing or administrative service providers;
- Where disclosure is required by law, a court, regulator or lawful authority;
- Where there appears to be a serious and imminent risk of harm to you or another person;
- Where reporting abuse, exploitation or another matter is legally required;
- To obtain confidential professional or legal advice;
- To investigate fraud, misconduct, a payment dispute or misuse of the service; or
- To establish, exercise or defend a legal claim.
- To other psychologists or psychiatrists to provide better service or for academic purposes.
Where reasonably possible and lawful, only the information necessary for the relevant purpose will be disclosed.
17. Session notes and records
I may maintain reasonable administrative or session records, including booking information, payment status, consent records, session dates, broad areas discussed and agreed follow-up actions.
Records will be accessed only for legitimate service, safety, legal, accounting, dispute-resolution and administrative purposes.
Please read the website Privacy Policy for more information about the personal data collected, the purposes of processing, retention, third-party sharing, security and your available rights.
18. Personal data and privacy
By booking a session, you acknowledge that personal information may be collected and processed to:
- Create and manage your booking;
- Communicate appointment information;
- Process payments;
- Verify consent and agreements;
- Deliver the requested service;
- Maintain appropriate records;
- Handle enquiries and grievances;
- Prevent fraud and misuse; and
- Comply with applicable legal, tax and accounting obligations.
Relevant information may be processed through service providers such as Amelia, WordPress, Hostinger, Razorpay, Zoho Sign, email providers, video-conferencing platforms and cloud-storage providers.
Any marketing communication requiring consent will use a separate choice where appropriate. Booking a session does not automatically require you to consent to unrelated promotional marketing.
You may contact hello@anukushwaha.com to request correction, updating or deletion of your information, subject to identity verification and any legal or legitimate record-retention requirements.
19. Recording sessions
Neither party may audio-record, video-record, photograph, transcribe through an automated service or otherwise reproduce a session without the other party’s prior written consent.
Where recording is proposed for a specific purpose, a separate consent process may be required. You may decline recording without affecting your access to the standard service.
20. No guaranteed outcome
Personal development and wellbeing outcomes vary between individuals and depend on many factors, including participation, circumstances, health, consistency, environment and personal choices.
No specific personal, emotional, medical, relationship, career, financial or performance result is promised or guaranteed.
Testimonials and examples describe individual experiences and do not guarantee that you will receive the same outcome.
21. Professional boundaries
The relationship between the Provider and Client is professional.
The services do not create a personal, employment, partnership, agency, fiduciary or joint-venture relationship.
Communication outside scheduled sessions should remain limited to booking, administrative matters and any follow-up arrangements expressly included in the service.
I may end communication or discontinue services where boundaries are repeatedly disregarded.
22. Intellectual property
Unless otherwise stated, the website content, session frameworks, written exercises, worksheets, videos, recordings, graphics, programme materials, book extracts and other original resources belong to Anu Kushwaha or the relevant rights holder.
You may use materials supplied to you for your own personal, non-commercial development.
You must not copy, publish, sell, distribute, teach, upload, reproduce, modify or commercially exploit the materials without prior written permission.
23. Third-party websites and services
The website may contain links to or integrations with third-party services.
I do not control every aspect of those services and cannot guarantee their continuous availability, security, accuracy or performance. Your use of a third-party service may also be governed by that provider’s terms and privacy policy.
A link or integration does not necessarily represent an endorsement of every statement, product or service offered by the third party.
24. Website availability
I may update, suspend or withdraw parts of the website for maintenance, security, technical, legal or business reasons.
Reasonable efforts will be made to maintain accurate information. However, occasional typographical, pricing, scheduling or technical errors may occur.
Where an obvious error affects your booking, I will contact you and offer a reasonable correction, alternative or refund where appropriate.
25. Misuse and prohibited conduct
You must not:
- Use the website unlawfully or fraudulently;
- Submit another person’s information without authority;
- Attempt unauthorised access to the website or booking system;
- Disrupt the website, payment gateway or online session;
- Harass, threaten or impersonate another person;
- Record or distribute confidential session content without consent;
- Use materials for unauthorised commercial purposes; or
- Make a booking for an unlawful or deceptive purpose.
Access may be restricted or terminated where these Terms are materially breached.
26. Limitation of liability
The services will be provided with reasonable care and skill.
To the extent permitted by law, I will not be liable for indirect, incidental or consequential losses that were not reasonably foreseeable when the booking was made.
Nothing in these Terms excludes or restricts liability for fraud, wilful misconduct, gross negligence or any liability or consumer remedy that cannot legally be excluded.
Nothing in these Terms requires you to waive a statutory right under applicable Indian law.
27. Force majeure
Neither party will be treated as breaching these Terms where performance is prevented or materially delayed by circumstances beyond reasonable control, including natural disaster, epidemic, government restriction, internet or power failure, civil disturbance, transport disruption or serious illness.
The affected party should communicate the situation as soon as reasonably possible. The parties will attempt to reschedule the session or agree on another fair solution.
28. Complaints and grievance redressal
For questions, complaints or grievances, contact:
Grievance contact: Anu Kushwaha
Email: help@BackToWellbeing.org
Telephone: +91 9959866113
Postal address: Kalp City, Lucknow, India
Your complaint should include your name, contact details, booking reference, appointment date and a clear description of the issue.
I will endeavour to acknowledge a grievance within 48 hours and resolve it within one month of receiving the complaint, subject to the nature and complexity of the matter.
This grievance process does not limit your right to approach an appropriate consumer commission, court, regulator or other authority where permitted by law.
29. Changes to these Terms
I may revise these Terms to reflect changes in services, technology, business practices or applicable law.
The updated version will be published on this page with a revised “Last updated” date.
The version accepted when you make a booking will generally govern that booking, unless a change is required by law or you expressly accept the updated terms.
30. Severability
If any provision of these Terms is found unlawful or unenforceable, it will be modified or removed only to the minimum extent necessary. The remaining provisions will continue to apply.
31. No waiver
A delay or failure to enforce a provision does not permanently waive the right to enforce it later.
32. Governing law and jurisdiction
These Terms are governed by the laws of India.
Subject to mandatory consumer-protection jurisdiction and any right that cannot legally be restricted, disputes will be subject to the jurisdiction of the competent courts and authorities at Lucknow, Uttar Pradesh, India.
Nothing in this clause prevents a consumer from using a forum or remedy available under applicable consumer-protection law.
